Terms and Conditions

Scope of Work

  • The contract documents shall contain the estimate, specification plans, and any other documents referred to in the estimate.
  • Only the items on the estimate specification are included and all works are due for payment.
  • The client is responsible for obtaining any necessary permits and fulfilling statutory requirements.

Estimates and Changes

  • ScenicYardWorks reserves the right to increase the contract value due to changes in design or materials requested by the client after execution of the contract, which may result in change order fees.
  • Acceptance of the estimate involves acceptance of these terms and conditions. This represents a binding contract between the parties.

Payment

  • The client accepts responsibility for paying ScenicYardWorks the full contract sum, including any tax properly chargeable.
  • Any materials brought to or removed from the site, excess to ScenicYardWorks' requirements, remain the possession of and are removable by the company.

Maintenance and Warranties

  • Proper maintenance of the site passes to the client upon practical completion, unless otherwise agreed in writing.
  • ScenicYardWorks provides a 1-year warranty on workmanship, but no warranty on plant materials or other products.

Liabilities

  • ScenicYardWorks accepts no liability for any negligent act, omission, or default under this contract, unless specifically agreed in writing.
  • The client agrees to indemnify and protect ScenicYardWorks from all lawsuits and costs pertaining to the landscaping services.

Change Orders

  • No modification of this agreement shall be valid unless in writing and agreed upon by both parties.
  • An additional estimate will be provided to the client for approval of any change orders prior to the work being performed.
By engaging ScenicYardWorks, the client agrees to these terms and conditions. The full terms can be provided upon request.
